Hemp growers have been licensed by the USDA since 1 January 2022; DATCP keeps consumer, food and labeling oversight of hemp and CBD products.

- Medical and adult-use cannabis remain illegal under state law.
- Wis. Stat. 961.32(2m): a person may possess a CBD product with a physician's certification issued within the past year; hemp products need no certification.
- 2025 Assembly Bill 547, a medical cannabis bill, failed to pass when the 2025-26 session ended (23 March 2026).
- Hemp: the USDA has licensed Wisconsin hemp growers directly since 1 January 2022; DATCP no longer runs a hemp licensing program.
- Federal change: from 12 November 2026, P.L. 119-37 sec. 781 limits hemp to 0.3% total THC and excludes final hemp-derived cannabinoid products over 0.4 mg total THC per container. Wisconsin's own hemp definition still counts delta-9 THC only.
